Legal Policy

1. Introduction
This Legal Policy ("Policy") governs the use of services provided by AapkaDesigner ("Company"), including but not limited to interior design services, design deliverables, and other related services. By engaging our services, the client ("Client") agrees to the terms outlined in this Policy.

2. Acceptance of Terms
By accepting a quotation or signing a contract with the Company, the Client agrees to be bound by this Policy and any additional terms outlined in the contract or quotation.

3. Scope of Services
The Company will provide interior design services as described in the quotation or contract. Any changes or additions to the scope of services must be agreed upon in writing and may result in additional charges.

4. Payment Terms
80% Advance + 20% Final Payment
Complete/Remaining files will be sent only after 100% Payment.

5. Refund Policy
Non-Refundable Payments: All payments made are non-refundable due to the customized nature of our services.
No Refunds for Change of Mind: Refunds will not be provided if the Client changes their mind or cancels the project after work has commenced.
Service Delays: If services are not rendered within 35 days after receiving the payment due to any issue, a refund will be provided.
Work in Progress: No refunds will be issued for work already completed or deliverables provided.

6. Client Responsibilities
The Client agrees to:
Provide accurate and timely information required for the project.
Provide timely feedback to ensure the project stays on schedule.
Make payments as per the agreed terms.

7. Confidentiality
All information exchanged during the course of the project will be treated as confidential. Both parties agree not to disclose any confidential information to third parties without prior written consent.

8. Intellectual Property
Ownership: All design work, including drawings, renderings, and other materials, remains the property of the Company until full payment has been received.
License: Upon full payment, the Client receives a license to use the design work for the specified project.

9. Liability
The Company will not be liable for any damages or losses incurred as a result of the design work. The Client agrees to indemnify and hold the Company harmless from any claims, damages, or expenses arising from the project.

10. Termination
Either party may terminate the agreement with written notice if the other party breaches any terms of the agreement. In the event of termination, the Client is responsible for payment for all work completed up to the date of termination.

11. Governing Law
This Policy and any disputes arising from it will be governed by and construed in accordance with the laws of the jurisdiction in which the Company operates.

12. Amendments
The Company reserves the right to amend this Policy at any time. Any amendments will be communicated to the Client in writing.

14. Design Iterations and Payment Policy
As part of our interior design services, we strive to gather comprehensive data and understand our clients' design preferences to create bespoke designs that meet their requirements. However, we acknowledge that there may be instances where the initial design may not fully align with the client's expectations. To address this, we offer a provision for design iterations, as follows: clients are entitled to one free design iteration. Subsequent iterations will incur a fee, up to a maximum of two additional iterations. Beyond this, we reserve the right to decline further design revisions. Due to the nature of our work, the time, and professional effort invested, clients are not entitled to a refund at any stage of the design process. By engaging our services, the client agrees to these terms and acknowledges that the design process is collaborative and iterative, and that our team will exert all reasonable efforts to achieve a satisfactory design outcome within the provided limits.

15. Payment and Legal Recourse Policy
In accordance with our service agreement, all clients are required to make timely payments for services rendered. If a client refuses or fails to make the agreed payments, we reserve the right to pursue legal action. As a registered company under the MSME (Udyam) framework, we are entitled to file a complaint with the Samadhan Portal to recover our service charges. Clients should be aware that non-payment after receiving our services will result in legal proceedings, and we are not liable for any consequences arising from such actions. By engaging our services, clients agree to these terms and acknowledge their obligation to fulfill payment requirements as stipulated in our service agreement.

16. Work Process and Timeline
The design process includes the following stages with approximate timeframes:
Brief Call: Initial discussion to understand Client requirements and preferences.
Modelling: 3-4 days to create 3D models of the design.
Rendering: 3-4 days to produce high-quality renderings of the design.
Post Rendering: 1-2 days for final touches and adjustments.

Disclaimer of Liability and Scope of Services
Aapkadesigner operates as an architectural visualization company, providing services strictly limited to visualizing interior spaces based on client-provided inputs and specifications. Our visualizations are for conceptual purposes only and should not be construed as architectural or engineering advice. Clients are responsible for ensuring that designs comply with all applicable laws, regulations, and building codes, and must consult with qualified professionals to verify feasibility and safety prior to implementation. Aapkadesigner shall not be liable for any damages, losses, or issues arising from the implementation of designs based on our visualizations, including structural integrity, safety, or legal compliance. Responsibility for construction or design work lies solely with the client and their chosen contractors. Our visualizations do not account for specific workspace requirements or ergonomic considerations unless explicitly provided by the client. Clients agree to indemnify and hold harmless Aapkadesigner, its employees, and agents from any claims, damages, or expenses arising from the use or implementation of our visualizations. By engaging our services, clients acknowledge and accept these terms, which clarify the nature of our services and protect both parties from misunderstandings or liabilities.

4. Refunds in Case of Project Delays

  • Completion Guarantee: If we are unable to complete the agreed-upon work within 35 business days from the project start date, you are eligible for a full refund.
  • Notification: In the event of a potential delay, we will notify you promptly and provide a revised timeline.
  • Refund Process: If the project is not completed within the stipulated 35 business days, you can request a refund by contacting us at support@aapkadesigner.com. Upon verification, the refund will be processed within [number] business days.

5. Partial Refunds for Partial Deliveries
